This Terms of Use Agreement (Agreement) constitutes a valid, binding contract between you and U.S. Global Investors, Inc. and its affiliates (U.S. Global), a Texas corporation, the owner and operator of usfundsbackup.wpengine.com, with respect to the use of this website (Site). The products and services of U.S. Global are provided subject to compliance with the terms of this Agreement. Your use of this Site signifies and constitutes your acceptance of this Agreement, as it may be amended from time to time. Please read this Agreement carefully as it forms a binding contract between you and U.S. Global.

Each of the mutual funds or services referred to on the Site may be offered only to persons in the United States. This Site should not be considered a solicitation or offering of any investment products or services to investors residing outside the United States.

Each of our mutual funds is described in a prospectus that contains more complete information about the fund, including management fees and other charges and expenses. Request a prospectus and read it carefully before you invest or send money. Registration and Pin Numbers

If you provide any information that is untrue, inaccurate, not current or incomplete, or U.S. Global has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, U.S. Global has the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).
When you register, you will be asked to select a PIN (personal identification number). You will also be given an opportunity to provide a PIN hint. If you forget your PIN, U.S. Global will provide you with the hint; however, to keep your information secure, U.S. Global cannot provide you with your PIN. Your PIN is your responsibility and must be protected. Treat your PIN to the Site as you would treat cash or your ATM PIN. By accepting this Agreement, you agree to each of the following:
(a) Not to give out your PIN to any other person. U.S. Global may rely on your PIN to identify you when providing services to you.
(b) Never to leave your PC unattended while using the Site.
(c) To always log off the system after using the Site.
(d) To notify U.S. Global immediately if you suspect that your PIN has become known to any unauthorized person. Please be aware that the policy regarding the unauthorized use of your PIN is very different from the policy your bank may have regarding unauthorized use of your credit card or ATM card. Unlike the bank, U.S. Global is not required to, and will not, insure you against the unauthorized use of your PIN. Rather, you are responsible for any activity via the Site using your PIN.
Security
Our highest priority is to ensure the privacy of your accounts. We take steps to ensure that your communications and transactions with U.S. Global through our website are as safe and reliable as any other means of doing business with us. Rest assured that U.S. Global will treat your registration information and other data with the appropriate safety and security features and confidentiality standards.
Our Account Access service uses a secure communications link between your computer and our computer networks. We have a digital certificate installed that uses a special means of communicating with your browser called Secure Sockets Layer Protocol (SSL). This establishes a digital handshake with your computer that verifies that when you connect to our website, you are establishing a secure connection. To provide you with access to your accounts from our website, we require the use of a Netscape Navigator or Microsoft Internet Explorer browser that supports 128-bit encryption. The 128-bit designation refers to the length of the key used to encrypt or scramble the data being transmitted.
On some systems, the Account Access section appears to be non-secure (the key or lock on the browser window appears broken) because of the site’s use of frames. This occurs because the browser will only secure the necessary page parts such as the account access frame; the actual data transfer over internet still occurs with SSL security. If for any reason you exit the Account Access system, your encrypted session will be interrupted, and you will need to log in again when returning to the Account Access system. Logging Off
Be certain to log off after accessing information on this Site. If you leave your computer and your session hasn’t “timed out,” or automatically shut down, another user could more easily access your account and any personal information therein.

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS U.S. GLOBAL FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS AND EXPENSES, INCLUDING WITHOUT LIMITATION CLAIMS BASED UPON THE NEGLIGENCE OF U.S. GLOBAL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, THE MATERIALS IT CONTAINS, THE USE OF YOUR PIN TO ACCESS OR USE THE SITE, AND ANY SITES LINKED TO THIS SITE.

Limitations and Exclusions of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT U.S. GLOBAL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF U.S. GLOBAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
(e) THE USE OR THE INABILITY TO USE THE SITE;
(f) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
(g) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE; OR
(h) ANY OTHER MATTER RELATING TO THE SITE.
IF YOU ARE DISSATISFIED WITH THE SITE, OR ANY OF THE INFORMATION CONTAINED THEREON, OR REFUSE TO ABIDE BY THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE YOUR USE. NOTWITHSTANDING THE FOREGOING, U.S. GLOBAL’S LIABILITY TO YOU SHALL BE LIMITED IN ALL INSTANCES TO YOUR ACCOUNT BALANCE, BUT IN NO CASE SHALL SUCH AMOUNT EXCEED $1,000. YOU FURTHER AGREE NOT TO JOIN IN ANY LAWSUIT WITH ANOTHER PERSON OR SERVE AS A CLASS REPRESENTATIVE OF ANY CLASS ACTION LAWSUIT AGAINST U.S. GLOBAL ARISING OUT OF THE USE OF THE SITE.
U.S. GLOBAL SHALL NOT BE HELD LIABLE FOR ANY REPRESENTATIONS ON THIRD PARTY SITES IN RELATION TO THE INFORMATION PROVIDED IN THIS SITE.
Intellectual Property Rights
The Site is protected by copyright, trademark, trade dress and other intellectual property rights.
(a) U.S. Global grants you a personal, revocable, non-transferable, and non-exclusive right and license to use the object code of the Site on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work from, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the software for the Site.
(b) The U.S. Global Investors logo, and other trademarks, service marks, logos, product names and service names (collectively, the Marks) are owned or licensed by U.S. Global. You agree not to copy, display or otherwise use any of the Marks without the prior written permission of U.S. Global.
(c) The entire Site, and all object code and source code associated therewith, are copyright 1998-2000, U.S. Global Investors, Inc. All rights reserved.
Modification
U.S. Global may update, revise, supplement, modify or amend this Agreement at any time. Any updates, revisions, supplements, modifications or amendments shall be effective immediately upon its posting on the Site. You agree that you will be bound by this Agreement, however and whenever it is updated, revised, supplemented, modified, or amended, whether you have actual or constructive notice of, and whether you have used or continue to use the Site after, the updates, revisions, supplements, modifications or amendments.
Entire Agreement
This Agreement constitutes the entire agreement between you and U.S. Global with respect to your use of the Site. There are no other representations, warranties, terms, agreements or conditions, either written or oral, with respect to your use of the Site except as set forth in this Agreement.
Severability
If any provision of this Agreement is deemed unlawful, void, voidable or unenforceable for any reason, then that provision shall be deemed severable from this Agreement and shall not affect the validity or enforceability of any remaining provisions.
Governing Law and Venue
This Agreement, the entire relationship between you and U.S. Global, and any litigation or other legal proceeding between you and U.S. Global (whether grounded in tort, contract, law or equity) shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to its choice of law rules.
This contract is fully performable in San Antonio, Texas. Any litigation arising between the parties hereto shall be brought only in the state or federal courts having subject matter jurisdiction in Bexar County, Texas. You hereby irrevocably and unconditionally consent to the jurisdiction of any such court and hereby irrevocably and unconditionally waive any defense of an inconvenient forum to the maintenance of any action or proceeding in any such court, any objection to venue with respect to any such action or proceeding, and any right of jurisdiction on account of the place of residence or domicile of any party thereto.
Termination
U.S. Global may terminate your right to use this Site, with or without cause at any time in its sole discretion, including, without limitation, your violation of this Agreement, failure to provide accurate registration data, and lack of use. In the event of termination, all representations, warranties, indemnifications, and promises made by you shall survive.
